Payment Agreement - Formal Legal Version

The Service is billed in two parts: (a) a one-time, non-refundable setup fee of $399, due upon signup and charged through Stripe, which covers the design and build of your website, your first month of hosting, setup and onboarding, and all features of your chosen tier for month 1; and (b) a monthly subscription at the Starter ($99/month), Professional ($175/month), or Premium ($249/month) tier, beginning month 2. The monthly subscription includes a 30-day free trial; the first monthly charge is billed on day 30, and monthly thereafter, automatically charged to your payment method on file through Stripe. The Service is month-to-month; no long-term contract is required. Payment must be received and cleared before any work starts; the 30-day delivery promise starts from the date payment clears.

The $399 setup fee covers the design and build of your website. The monthly subscription covers hosting, DDoS protection, SSL, on-site SEO, security monitoring, backups, mobile-responsive design, a contact form, and a monthly limit of change requests (Starter 1, Professional 4, Premium 8) with tier-based turnaround (3-5, 2-3, or 1-2 business days). Legal pages (terms, privacy, cookies) are included on all tiers at no extra cost and are not counted toward your page limit (5, 8, or 25 pages respectively). The full scope is described on our Services page and in our Service Level Agreement. Add-ons (custom email, logo design, domain registration, extra change requests at $25 each) are billed separately.

All payments are processed by Stripe, Inc. We do not store your credit card information; Stripe handles payment data securely in accordance with PCI-DSS. Your use of Stripe is subject to Stripe's Terms of Service (https://stripe.com/legal) and Stripe's Privacy Policy (https://stripe.com/privacy), each incorporated herein by reference.

If we fail to deliver a Draft of your website within 30 days of your payment clearing, we will refund everything you have paid, including the $399 setup fee and any monthly subscription charges. The setup fee covers work that begins immediately upon signup (design, build, onboarding); once that work is underway it is generally non-refundable except under this 30-day delivery promise. Domain names, custom email, and other add-ons are non-refundable. Once a Draft is delivered to you, the 30-day promise is fulfilled and you are no longer eligible for a refund under this section. Refunds are processed through Stripe and may take several business days to appear on your statement, subject to Stripe's processing timeline.

You may cancel the Service at any time. The Service is month-to-month. Upon cancellation, we will prepare your Website Files for transfer in accordance with our Cancellation & Data Retention Policy, which is incorporated herein by reference.

If a payment fails, we will notify you by email. You will have 3 days to update your payment method. If payment is not received within 3 days, we may suspend the Service, including hosting of your website, until payment is received. We will provide reasonable notice before suspension.

We do not currently plan to change our pricing. If we ever do, we will provide you with at least 30 days' notice before any change takes effect. You may cancel the Service before the price change takes effect to avoid the new price.

Domain names are billed separately and annually, based on the cost of the specific domain. We will discuss the cost with you before registering a domain. Domain fees are non-refundable once the domain is registered, because the registrar's fees are non-refundable to us.

You are responsible for any sales, use, or similar taxes applicable to your use of the Service, other than taxes on our income. The setup fee and the monthly subscription fees are exclusive of any such taxes unless itemized on your invoice.

Our liability arising from this Payment Agreement is subject to the limitation of liability set forth in our Terms of Service (the 3-month paid-amount cap). We are not liable for any failure of Stripe to process a payment, except to the extent such failure is caused by our own breach.
