1. Definitions

"JD's Web Service," "we," "us," and "our" have the meanings set forth in our Terms of Service. "Your Website" means the website we built and host for you under the Service. "Website Files" means all source code, content, and assets comprising Your Website. "Internal Project Files" means our project notes, planning documents, and development files, which are our internal work product and are not part of Your Website. "Setup Guide" means a document describing the technical requirements for deploying Your Website on a new server.

2. Cancellation Procedure

You may cancel the Service at any time by emailing [email protected] or using the cancel button in your client portal, when available. There are no long-term contracts and no cancellation fees. Cancellation is effective at the end of the billing period in which you cancel, except that no further charges will be made after the cancellation date.

3. Website File Transfer Obligations

Upon cancellation, we will: (a) prepare your Website Files for transfer, including the Setup Guide; (b) send you a release form asking whether you authorize us to use Your Website's code as reference or in future projects (Yes or No); and (c) transfer the Website Files to you. The Website Files include all site code and the Setup Guide. They do NOT include login credentials or passwords, which are stored separately and encrypted.

4. Code Reuse Permission

If you authorize code reuse (answer "Yes" on the release form), we may use Your Website's code as reference or in future projects. Your Website Files are transferred to you regardless; you own your website.

If you do not authorize code reuse (answer "No"), we will transfer your Website Files to you and, after you confirm receipt or after 30 days (whichever comes first), completely delete Your Website from our servers. Once deleted, Your Website cannot be restored except from the Website Files we transferred to you.

5. Internal Project Files

Our Internal Project Files remain on our servers after cancellation. They are our internal work product (project notes, planning documents, development files) and are not part of Your Website. We retain them indefinitely for our own business purposes.

6. Domain Transfer

If we registered a domain name on your behalf, it is registered in your name. Upon cancellation, we will transfer the domain to you through our domain registrar. The domain is your property and is not affected by cancellation of the Service.

7. Stripe Subscription Cancellation

Upon cancellation, we will cancel your Stripe subscription. You will not be charged again. If you are due a refund under the 30-day delivery promise, we will process it through Stripe subject to Stripe's processing timeline. See our Payment Agreement for refund details.

8. Setup Guide Scope and Disclaimer

The Setup Guide is provided as a courtesy. It describes the technical requirements for deploying Your Website on a new server, including project requirements (PHP 8.4, Laravel 13, and other technical specifications), server setup instructions, Laravel setup commands, and cron job or scheduler configuration. After cancellation, we are not available for migration assistance or technical support. Any assistance your new developer requires in setting up a standard PHP/Laravel website is a matter between you and that developer.

9. Data Retention

We retain billing records and tax-related documents for as long as required by applicable tax law. We retain the cancellation record itself. We delete Your Website in accordance with Section 4 if you do not authorize code reuse. We retain Internal Project Files in accordance with Section 5. Except as set forth in our Privacy Policy, we do not retain your Personal Data after cancellation beyond what is required for legal compliance.
