In this Privacy Policy, the following terms have the following meanings:

"JD's Web Service," "we," "us," and "our" refer to the sole proprietorship operating at jdswebservice.com. "You" and "your" refer to any visitor to jdswebservice.com or any individual who submits information through our consultation form or otherwise becomes a client. "Personal Data" means any information relating to an identified or identifiable individual, including name, email address, phone number, mailing address, and business information. "The Service" refers to the website design, hosting, and maintenance services we provide under a tiered subscription model (a one-time $399 setup fee followed by a monthly Starter, Professional, or Premium subscription). "Stripe" refers to Stripe, Inc., our third-party payment processor.

We collect Personal Data that you voluntarily provide through our consultation form, including: your name, business name, business address, email address, phone number and phone type, industry or business type, current website URL, the goals you have for your website, and the reason you are contacting us. If you become a client, we additionally collect payment information processed by Stripe (we do not store your credit card number) and information you provide during the intake process, including business details, content, and photographs.

We also collect limited technical information automatically, including IP address, browser type, and usage data through a privacy-friendly analytics tool. We do NOT use Google Analytics and do NOT use advertising or tracking cookies.

We use your Personal Data to: (a) contact you about your consultation request; (b) build, host, and maintain your website if you become a client; (c) process your payments through Stripe; (d) send you important notices about your account or our Service; and (e) improve our website and services. We do NOT sell your Personal Data to any third party. We do NOT use your Personal Data for marketing emails. We share your Personal Data only with Stripe (for payment processing) and our hosting provider (for hosting your website), each acting as a processor under our instructions.

If you submit the consultation form but do not become a client, we retain your submission in our database until you request deletion. If you become a client, your data is retained in accordance with our Cancellation & Data Retention Policy, which is incorporated herein by reference. We retain billing records and tax-related documents for as long as required by applicable tax law.

Subject to applicable law, including the California Consumer Privacy Act (CCPA) and the California Online Privacy Protection Act (CalOPPA), you have the right to: (a) request access to the Personal Data we hold about you; (b) request correction of inaccurate Personal Data; (c) request deletion of your Personal Data, subject to our legal retention obligations; and (d) opt out of analytics tracking through your browser settings. This Privacy Policy reflects awareness of CCPA and CalOPPA. We target users located in the United States and do not intentionally collect data from individuals in the European Union; we are not GDPR-compliant and do not represent ourselves as such.

We take reasonable technical and organizational measures to protect your Personal Data, including SSL encryption in transit, secure hosting with DDoS protection, and regular backups. No method of transmission or electronic storage is 100% secure. We cannot guarantee absolute security, but we work to protect your information using industry-standard practices.

To the maximum extent permitted by applicable law, our total liability arising from any unauthorized access to or disclosure of your Personal Data is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost revenue or lost profits, arising from a data breach.

This Privacy Policy does not cover the practices of Stripe or our hosting provider. Stripe's Privacy Policy is available at https://stripe.com/privacy. We encourage you to review the privacy policies of any third party we use.

We may update this Privacy Policy from time to time. If we make significant changes, we will notify you by email. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our Service after changes constitutes acceptance of the updated Privacy Policy.
