Privacy Policy

1. About This Policy; Who We Are

This Privacy Policy ("Policy") explains how "JD's Web Service," a sole proprietorship operating from Pennsylvania, handles personal information in connection with the website at jdswebservice.com, which our Terms of Service call the "Site." "We," "us," and "our" mean that sole proprietorship. The Terms of Service govern use of the Site; this Policy covers the privacy side of that use.

Site use is limited to people at least 18 years old under our Terms of Service. We do not knowingly ask for personal information from anyone younger.

2. When This Policy Applies to Client Information

This Policy covers the personal information people give us through the Site, including anyone who asks about our services. If you are a client under a service agreement you signed with us (a "Signed Service Agreement" as defined in the Terms of Service), two boundaries apply:

• The information you share with us as part of the client relationship, including project materials and any records the signed agreement requires, is handled under the signed agreement, and the signed agreement prevails over this Policy for that information.
• The payment and cancellation pages on the Site are public descriptions of our services, not the contract itself. The signed agreement controls wherever the two differ.

3. Personal Information We Collect

The information we hold comes from three places: what you give us directly, what the Site records as you use it, and what the Site's features record. This section covers the first two places; Section 4 covers the features.

• Consultation form submissions. The form on the Site records what the form asks for: your name, email address, phone number, business name, your website address if you choose to give it, your preferred contact method (call or email), and the message you write.
• Internal form notices. When a form is submitted, an internal notification is queued and sent to our own email inbox so we can see it promptly. That notice contains the fields listed above.
• Copyright reports. The copyright report form on the Site records what a report says: the target and website involved, the exact URLs of the material the report names, the reporter's role relative to the copyright owner, identity and contact items (full legal name, company, email address, phone number, and mailing address), the description of the copyrighted work, any optional link to the original work and additional details, the statements the form requires and the typed full legal name that acts as the reporter's electronic signature, and any attachments, which are stored privately. We also record with each report the date and time of its submission and the IP address of the person who submitted it; that address is used to keep the notice process trustworthy, it is visible only to the people who handle the report, it is never displayed publicly, and it never appears in the reporter receipt. Our DMCA and Copyright Policy describes copyright reports and what we do with them.
• Site analytics. The Site runs its own analytics software, which we host ourselves on servers we control (named in Section 6). It records IP addresses, referrer URLs (including referrers that arrive from advertising campaigns), the pages viewed on the Site, the dates and times of visits, device and browser information, and similar engagement details such as clicks and other interactions or events it is configured to record.
• Abuse prevention. IP addresses are also checked to slow automated form abuse and keep the forms working.

4. Information Collected by Site Features

• Client portal accounts. The client portal area records a name, an email address, and the account credentials you set, plus anything you send through the portal, such as messages, files, and documents you sign.
• E-signed contracts. When you sign a document electronically, we record your full legal name, the document you signed, and the date and time of the signature.
• Online payments. Online payments run through the payment processor named in Section 6. Payment card details go to that processor, not to us.
• Access details you choose to send. When you send us access details (for example, an email server login or website credentials) so we can set up services for you, we use them to perform that setup work only.
• Profiles. Profiles hold whatever details you choose to place in your profile.
• Advertising. The Site displays advertising. Advertising performance (impressions, clicks, and where visitors came from) is measured with the analytics described in Section 3. Advertising may use tracking cookies; tracking cookies are Personal Cookies under Section 7, and they run only when you accept them in the cookie banner.
• Demonstration sites. Work we showcase as demonstration sites is fictional and clearly marked as demos; it does not involve real personal information, and we ask that you never submit real information on a demo site.

5. How We Use Personal Information

We use personal information to:

• answer inquiries and prepare proposals;
• provide and manage the services a client has engaged us for, whether through the Site or a Signed Service Agreement;
• operate, secure, and protect the Site, including spam prevention and abuse handling;
• run the Site's analytics and advertising, including measuring page views, referrer sources, and advertising performance;
• keep records the law or a Signed Service Agreement requires.

We also use personal information to review and act on copyright reports: reviewing the report, contacting the reporter or the affected client where the DMCA and Copyright Policy calls for it, removing or disabling material it identifies, and handling counter-notifications, including under our repeat-infringer policy.

Advertising on the Site is measured with our own analytics. We do not sell or rent personal information.

6. When and How We Share Personal Information

We do not sell, rent, or share personal information as "sell" and "share" are used in the California law named in Section 11. Beyond that, we share personal information only as the list below allows:

• Service providers. Companies that help us operate the Site and deliver our work, such as our website hosting and email delivery providers, may process personal information only under our instructions.
• Payment processing. Online payments run through Stripe. Stripe holds the payment details, and we do not store full card numbers on our side.
• Our own analytics and advertising. The analytics software is Matomo, and we host it ourselves so it runs on servers we control; analytics and advertising records stay in our own systems.
• Copyright reports. Report details are shared with the people who handle the report and, for a report naming a client's website, with that client. A counter-notification we receive is forwarded to the original reporter, and it carries the counter-notifying person's own contact details. Our DMCA and Copyright Policy describes this process.
• Legal requirements. We may share personal information when law, legal process, or the protection of our or others' rights, property, or safety requires it.

We never name the particular companies behind hosting, email delivery, domains, or design work in this Policy.

7. Cookies: Essential Cookies and Personal Cookies

The Site sets two kinds of cookies. Essential Cookies are the cookies the Site needs to operate; they include the record of your cookie choice in your browser's local storage and similar functions the Site requires to work. Personal Cookies are the tracking cookies behind the Site's analytics and advertising described in Sections 3 and 4.

Your choice comes from the cookie banner that appears at the bottom of the screen. The banner offers exactly two buttons: Accept All, which is highlighted, and Just Essential Cookies. If you accept all, Personal Cookies run and the Site's analytics and advertising record your visit. If you do not accept tracking cookies, Personal Cookies are not set, and we do not track you further; the analytics and advertising features that depend on them do not record your activity. Clearing the banner's stored choice in your browser's local storage makes the banner ask again.

We keep the full cookie detail (each cookie, what it does, and what depends on it) in our Cookies Policy instead of repeating it here, so there is one list that does not drift.

8. How Long We Keep Personal Information

We keep inquiry records, including every form submission, indefinitely unless you ask us to delete them under Section 10. Analytics and advertising records are kept the same way, indefinitely unless you ask us to delete them. Copyright report records, including their attachments and the IP address recorded with a report, are kept the same way: indefinitely unless we are asked to delete them under Section 10. We do not run an automatic deletion routine; deletion happens at your request. Information connected to a Signed Service Agreement is kept under the rules of that signed agreement.

9. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information: data travels over HTTPS, access is limited to the operator, and we follow general safe-practice measures on our systems and our services. Online payments run through Stripe, and we do not store full card numbers on our side; the payment processor holds payment data. The servers that host our analytics receive the same safeguard practices. No method of transmission or storage is perfectly secure, so we cannot promise that any security measure is perfect, but we do take the protection of personal information seriously.

10. Your Rights; How to Exercise Them

You may ask us to:

• show you the personal information we hold about you;
• correct the personal information we hold about you;
• delete the personal information we hold about you (for example, an old inquiry record);
• answer questions about anything in this Policy.

To exercise any of these, use the contact form on the Site and put a short note such as "privacy request" in your message. Form submissions reach [email protected], the same inbox our Terms of Service points data and account matters to, so the two documents use one route and one inbox. If we need to confirm a request really came from you, we will reply to the contact point with your message and ask a short verifying question before acting on the request.

11. Your California Privacy Rights

This section applies to California residents. Rights described here are framed by the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

• What we collect falls into these categories: identifiers and contact information (name, email address, phone number, mailing address, and IP addresses, including the IP addresses our analytics processes and the one recorded with a copyright report), business information (business name, website address), internet or other electronic network activity information (pages viewed, referrer URLs, interactions with the Site, and advertising performance records), and the content of your message, the content of copyright reports and their attachments, and anything you send through the portal.
• Advertising on the Site is measured with our own analytics, and we do not sell or share personal information as "sale" and "sharing" are used in that law, so there is nothing to opt out of.
• You have the right to know, access, correct, and delete personal information we hold about you, and the right not to be treated worse for exercising any of these rights.
• Requests run through the route in Section 10, and we will respond within the periods California law requires.

12. Visitors from the EU, EEA, or the United Kingdom

If you use the Site from the European Union, the European Economic Area, or the United Kingdom:

• We follow these principles: lawful, fair, and transparent processing; using information only for the purposes described here; collecting only what is needed; keeping it accurate; keeping it only as long as needed; and keeping it secure.
• Our bases for processing are your consent (you give it through the cookie banner for Personal Cookies, and when you submit a form) and our legitimate interests in answering you and keeping the Site secure.
• You have the right to access, correct, erase, restrict, and port your personal information, to object to certain processing, to withdraw consent, and to complain to the supervisory authority where you live.
• Your information is stored on servers located in the United States.
• Requests use the same route as Section 10.

13. Changes to This Policy

We may change this Policy at any time, and the updated version takes effect immediately when it is posted. That is our house rule for every legal document we publish; our Terms of Service carry the same rule, so the two never disagree on when changes start.

14. Contacting Us

Privacy requests travel through the route in Section 10 (the contact form with a "privacy request" note, which lands in the [email protected] inbox). For anything else, our Terms of Service name [email protected] as the address for questions and legal notices, and that remains our mailbox for this Policy.
